ถ้าบุคคลใดซึ่งถูกร้องขอให้ส่งข้ามแดนนั้นเคยได้รับการพิจารณาคดีจากศาลไทย หรือศาลของประเทศผู้ร้องขอในการกระทำอย่างเดียวกันกับที่มีการร้องขอ ให้ส่งข้ามแดนและศาลไทย หรือศาลของประเทศผู้ร้องขอได้มีคำพิพากษาถึงที่สุดให้ปล่อยตัวหรือพิพากษาให้ลงโทษและผู้นั้น ได้พ้นโทษแล้ว หรือได้รับการอภัยโทษหรือนิรโทษกรรมหรือคดีขาดอายุความหรือมีเหตุอื่นใด ซึ่งไม่สามารถดำเนินคดีแก่บุคคลนั้นตามกฎหมายของประเทศผู้ร้องขอ ห้ามมิให้ส่งบุคคลดังกล่าว เป็นผู้ร้ายข้ามแดนเนื่องจากการกระทำนั้นอีก
