ในกรณีที่ประเทศผู้ร้องขอมิได้ดำเนินการรับมอบตัวบุคคลซึ่งถูกร้องขอให้ ส่งข้ามแดนภายในกำหนดเวลาตามมาตรา ๒๒โดยไม่มีเหตุอันควร หากต่อมาภายหลังได้ร้องขอให้ ส่งบุคคลนั้นข้ามแดนในความผิดเดียวกันอีก ให้ปฏิเสธการส่งผู้ร้ายข้ามแดน การปฏิเสธการส่งผู้ร้ายข้ามแดนตามวรรคหนึ่ง มิให้นำความในมาตรา ๒๕มาใช้บังคับ
