ในกรณีที่หน่วยงานของรัฐที่ไม่ใช่รัฐวิสาหกิจและองค์กรปกครองส่วนท้องถิ่น ไม่มีความจำเป็นต้องใช้จ่ายเงินนอกงบประมาณหรือมีเงินนอกงบประมาณมากเกินสมควร ให้กระทรวงการคลัง เรียกให้หน่วยงานของรัฐนำเงินดังกล่าวส่งคลัง ทั้งนี้ ตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่รัฐมนตรีกำหนด โดยความเห็นชอบของคณะรัฐมนตรี
