ในกรณีที่มีการทำสัญญาไว้ก่อนเกิดภยันตราย การปฏิบัติตามสัญญานั้น ไม่ก่อให้เกิดสิทธิที่จะได้รับเงินตอบแทน เว้นแต่การปฏิบัติการนั้นเป็นการกระทำนอกเหนือไปจาก ขอบเขตหน้าที่ตามสัญญานั้น
