นอกจากการพ้นจากตำแหน่งตามวาระ กรรมการผู้ทรงคุณวุฒิพ้นจากตำแหน่งเมื่อ
(๑) ตาย
(๒) ลาออก
(๓) คณะรัฐมนตรีให้ออก เพราะบกพร่องต่อหน้าที่ มีความประพฤติเสื่อมเสีย หรือ หย่อนความสามารถ
(๔) เป็นบุคคลล้มละลาย
(๕) เป็นคนไร้ความสามารถหรือคนเสมือนไร้ความสามารถ
(๖) ได้รับโทษจำคุกโดยคำพิพากษาถึงที่สุดให้จำคุก เว้นแต่เป็นโทษสำหรับความผิดที่ได้กระทำ โดยประมาทหรือความผิดลหุโทษ
