เจ้าพนักงานเรือนจำจะรับบุคคลใดๆ ไว้เป็นผู้ต้องขังในเรือนจำได้ต่อเมื่อได้รับ หมายอาญาหรือเอกสารอันเป็นคำสั่งของผู้มีอำนาจตามกฎหมาย โดยให้ผู้มีอำนาจออกหมายอาญา หรือเอกสารดังกล่าว ระบุเลขประจำตัวประชาชน หรือเอกสารแสดงตนของผู้ต้องขังเท่าที่ทราบด้วย
