ภายใต้บังคับมาตรา ๔๐เพื่อประโยชน์ในการบริหารจัดการผู้ต้องขังภายในเรือนจำ ให้อธิบดีจัดให้มีระบบการจัดชั้น การจัดกลุ่มผู้ต้องขัง และการแยกคุมขัง โดยต้องคำนึงถึงประเภท หรือชั้นของเรือนจำที่ได้จำแนกไว้ตามมาตรา ๓๑ และความเหมาะสมกับผู้ต้องขัง แต่ละประเภท แต่ละชั้น การควบคุม แก้ไข บำบัด ฟื้นฟู และพัฒนาพฤตินิสัยผู้ต้องขัง ตลอดจนการเตรียมความพร้อมก่อนปล่อย ทั้งนี้ ให้เป็นไปตามกฎกระทรวงโดยได้รับความเห็นชอบจากคณะกรรมการ
