กรมราชทัณฑ์อาจดำเนินการให้มีมาตรการบังคับโทษด้วยวิธีการอื่นนอกจาก การควบคุม ขัง หรือจำคุกไว้ในเรือนจำ แต่มาตรการดังกล่าวต้องไม่ขัดต่อประมวลกฎหมายวิธีพิจารณา ความอาญา รวมตลอดถึงกฎหมายอื่นที่เกี่ยวข้อง ทั้งนี้ ตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่กำหนด ในกฎกระทรวงโดยได้รับความเห็นชอบจากคณะกรรมการ
