ในกรุงเทพมหานคร ให้พนักงานอัยการซึ่งรับราชการประจำอยู่ในราชการส่วนกลาง เป็นพนักงานอัยการประจำศาลชั้นต้นทุกศาล ให้อัยการสูงสุดหรือรองอัยการสูงสุดหรืออธิบดีอัยการ ที่ได้รับมอบหมายหน้าที่จากอัยการสูงสุดเป็นหัวหน้าในการปฏิบัติราชการของพนักงานอัยการประจำ ศาลชั้นต้นนั้น
