ให้สำนักงานอัยการสูงสุดเสนองบประมาณรายจ่ายต่อคณะรัฐมนตรีเพื่อจัดสรร เป็นเงินอุดหนุนสำนักงานอัยการสูงสุดไว้ในร่างพระราชบัญญัติงบประมาณรายจ่ายประจำปีงบประมาณ หรือร่างพระราชบัญญัติงบประมาณรายจ่ายเพิ่มเติม หรือร่างพระราชบัญญัติโอนงบประมาณรายจ่าย แล้วแต่กรณี ในกรณีที่สำนักงานอัยการสูงสุดเห็นว่างบประมาณรายจ่ายที่ได้รับการจัดสรรให้ไม่เพียงพอ ให้สำนักงานอัยการสูงสุดเสนอคำขอแปรญัตติต่อคณะกรรมาธิการพิจารณางบประมาณของ สภาผู้แทนราษฎรได้โดยตรง
