กำหนดให้เจ้าหน้าที่ของรัฐดังต่อไปนี้ เป็นผู้มีอำนาจปรับเป็นพินัยในความผิด ทางพินัยตามความในมาตรา ๖๘แห่งพระราชบัญญัติควบคุมน้ำมันเชื้อเพลิง พ.ศ. ๒๕๔๒ในเขตจังหวัด ที่รับผิดชอบ
(๑) ผู้ว่าราชการจังหวัด
(๒) พลังงานจังหวัด
(๓) ข้าราชการสังกัดกระทรวงพลังงานที่มีตำแหน่งไม่ต่ำกว่าชำนาญการขึ้นไป หรือเทียบเท่าในพื้นที่จังหวัดที่ได้รับผิดชอบที่ได้รับมอบหมายจากผู้ว่าราชการจังหวัด
