งานจ้างก่อสร้างที่มีขั้นตอนการดำเนินการเป็นระยะๆ อันจำเป็นต้องมี การควบคุมงานอย่างใกล้ชิด หรือมีเงื่อนไขการจ่ายเงินเป็นงวดตามความก้าวหน้าของงาน ให้มีผู้ควบคุมงาน ซึ่งแต่งตั้งโดยผู้มีอำนาจเพื่อรับผิดชอบในการควบคุมงานก่อสร้างนั้น การแต่งตั้ง คุณสมบัติ และหน้าที่ของผู้ควบคุมงาน ให้เป็นไปตามระเบียบที่รัฐมนตรีกำหนด ค่าตอบแทนผู้ควบคุมงานตามวรรคหนึ่ง ให้เป็นไปตามที่กระทรวงการคลังกำหนด
