ในกรณีที่เห็นสมควร รัฐมนตรีอาจออกระเบียบกำหนดการประเมินผล การปฏิบัติงานอื่นนอกเหนือจากความสามารถในการปฏิบัติงานให้แล้วเสร็จตามสัญญาก็ได้ เพื่อประโยชน์ ในการพัฒนาและปรับปรุงประสิทธิภาพการจัดซื้อจัดจ้างและการบริหารพัสดุภาครัฐให้มีประสิทธิภาพยิ่งขึ้น และให้นำบทบัญญัติมาตรา ๑๐๖ วรรคสามและวรรคสี่ มาใช้บังคับกับการประเมินผลการปฏิบัติงานอื่น โดยอนุโลม
