ในกรณีที่กฎหมายว่าด้วยสถาบันอุดมศึกษาเอกชน กำหนดอัตราค่าปรับ เป็นพินัยสูงสุดไว้ไม่เกินหนึ่งหมื่นบาท ให้เจ้าหน้าที่ของรัฐตามข้อ ๑คนเดียวเป็นผู้มีอำนาจพิจารณา การปรับเป็นพินัยได้
