การพิจารณาและดำเนินการปรับเป็นพินัยในความผิดทางพินัยตามความใน มาตรา ๑๑๐แห่งพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. ๒๕๓๕ต้องทำ เป็นองค์คณะประกอบด้วยเจ้าหน้าที่ของรัฐตามข้อ ๑จำนวนไม่น้อยกว่าสามคนซึ่งมีหัวหน้าองค์คณะ หนึ่งคน และองค์คณะอีกไม่น้อยกว่าสองคน
