ผู้ใดกระทำการใด ๆเพื่อให้เกิดเหตุร้ายแก่ประเทศจากภายนอก ต้อง ระวางโทษจำคุกไม่เกินสิบปี ถ้าเหตุร้ายเกิดขึ้น ผู้กระทำต้องระวางโทษประหารชีวิต หรือจำคุกตลอดชีวิต หรือ จำคุกตั้งแต่สองปีถึงยี่สิบปี
