ถ้ การกระทำความผิดตามมาตรา ๒๗๖วรรคสามหรือมาตรา ๒๗๗วรรคสี่ เป็นเหตุให้ผู้ถูกกระทำ
(๑) รับอันตรายสาหัส ผู้กระทำต้องระวางโทษประหารชีวิต หรือจำคุกตลอดชีวิต
(๒) ถึงแก่ความตาย ผู้กระทำต้องระวางโทษประหารชีวิต
