ถ้าการกระทำความผิดตามมาตรา ๒๗๘หรือมาตรา ๒๗๙เป็นเหตุ ๘)พ.ศ. ๒๕๓๐ ๘)พ.ศ. ๒๕๓๐ ๕)พ.ศ. ๒๕๒๕ ให้ผู้ถูกกระทำ
(๑) รับอันตรายสาหัสผู้กระทำต้องระวางโทษจำคุกตั้งแต่ห้าปีถึงยี่สิบปี และปรับตั้ง แต่หนึ่งหมื่นบาทถึงสี่หมื่นบาท
(๒) ถึงแก่ความตายผู้กระทำต้องระวางโทษประหารชีวิต หรือจำคุกตลอดชีวิต
