ถ้าการกระทำความผิดดังกล่าวในมาตรา ๓๐๑และมาตรา ๓๐๒นั้น เป็การกระทำของนายแพทย์และ
(๑) จำเป็นต้องกระทำเนื่องจากสุขภาพของหญิงนั้น หรือ
(๒) หญิงมีครรภ์เนื่องจากการกระทำความผิดอาญาตามที่บัญญัติไว้ในมาตรา ๒๗๖ มาตรา ๒๗๗มาตรา ๒๘๒มาตรา ๒๘๓หรือมาตรา ๒๘๔ ผู้กระทำไม่มีความผิด
