ผู้ใดทอดทิ้งเด็กอายุยังไม่เกินเก้าปีไว้ ณที่ใด เพื่อให้เด็กนั้นพ้นไปเสีย จากตนโดยประการที่ทำให้เด็กนั้นปราศจากผู้ดูแล ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกิน หกพันบาทหรือทั้งจำทั้งปรับ
