ผู้ใดมีหน้าที่ตามกฎหมายหรือตามสัญญาต้องดูแลผู้ซึ่งพึ่งตนเองมิได้ เพราะอายุ ความป่วยเจ็บ กายพิการหรือจิตพิการ ทอดทิ้งผู้ซึ่งพึ่งตนเองมิได้นั้นเสียโดยประการที่ น่าจะเป็นเหตุให้เกิดอันตรายแก่ชีวิต ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกพันบาท หรือทั้งจำทั้งปรับ
