ถ้าผู้กระทำความผิดตามมาตรา ๓๑๓มาตรา ๓๑๔หรือมาตรา ๓๑๕ จัดให้ผู้ถูกเอาตัวไป ผู้ถูกหน่วงเหนี่ยวหรือผู้ถูกกักขังได้รับเสรีภาพก่อนศาลชั้นต้นพิพากษาโดยผู้นั้น มิได้รับอันตรายสาหัสหรือตกอยู่ในภาวะอันใกล้จะเป็นอันตรายต่อชีวิต ให้ลงโทษน้อยกว่าที่กฎหมาย กำหนดไว้ แต่ไม่น้อยกว่ากึ่งหนึ่ง
