Consolidated edition — not the text as first promulgatedถ้าการกระทำความผิดตามมาตรา ๓๑๐ทวิ หรือมาตรา ๓๑๒ เป็นการกระทำต่อเด็กอายุยังไม่เกินสิบห้าปี ผู้กระทำต้องระวางโทษจำคุกตั้งแต่สามปีถึงสิบปี และ ปรับไม่เกินสองหมื่นบาท ถ้าการกระทำความผิดตามวรรคแรก หรือมาตรา ๓๑๐ทวิ หรือมาตรา ๓๑๒เป็น เหตุให้ผู้ถูกกระทำ
(๑) รับอันตรายแก่กายหรือจิตใจ ผู้กระทำต้องระวางโทษจำคุกตั้งแต่ห้าปีถึงสิบห้าปี และปรับไม่เกินสามหมื่นบาท
(๒) รับอันตรายสาหัส ผู้กระทำต้องระวางโทษจำคุกตลอดชีวิต หรือจำคุกตั้งแต่เจ็ดปี ถึงยี่สิบปี
(๓) ถึงแก่ความตายผู้กระทำต้องระวางโทษประหารชีวิต จำคุกตลอดชีวิต หรือ จำคุกตั้งแต่สิบห้าปีถึงยี่สิบปี
