ผู้ใดใส่ความผู้ตายต่อบุคคลที่สามและการใส่ความนั้นน่าจะเป็นเหตุ ให้บิดา มารดา คู่สมรสหรือบุตรของผู้ตายเสียชื่อเสียง ถูกดูหมิ่นหรือถูกเกลียดชัง ผู้นั้นกระทำ ความผิดฐานหมิ่นประมาทต้องระวางโทษดังบัญญัติไว้ในมาตรา ๓๒๖นั้น
