ถ้าศาลเห็นว่า การปล่อยตัวผู้มีจิตบกพร่อง โรคจิตหรือจิตฟั่นเฟือน ซึ่ง ไม่ต้องรับโทษหรือได้รับการลดโทษตามมาตรา ๖๕จะเป็นการไม่ปลอดภัยแก่ประชาชนศาลจะสั่งให้ ส่งไปคุมตัวไว้ในสถานพยาบาลก็ได้ และคำสั่งนี้ศาลจะเพิกถอนเสียเมื่อใดก็ได้
