ผู้ใดลงมือกระทำความผิดแต่กระทำไปไม่ตลอด หรือกระทำไปตลอด แล้วแต่การกระทำนั้นไม่บรรลุผล ผู้นั้นพยายามกระทำความผิด ผู้ใดพยายามกระทำความผิด ผู้นั้นต้องระวางโทษสองในสามส่วนของโทษที่กฎหมาย กำหนดไว้สำหรับความผิดนั้น
