ผู้ใดพยายามกระทำความผิดหากยับยั้งเสียเองไม่กระทำการให้ตลอด หรือกลับใจแก้ไขไม่ให้การกระทำนั้นบรรลุผล ผู้นั้นไม่ต้องรับโทษสำหรับการพยายามกระทำความผิด นั้น แต่ถ้าการที่ได้ ระทำไปแล้วต้องตามบทกฎหมายที่บัญญัติเป็นความผิดผู้นั้นต้องรับโทษสำหรับ ความผิดนั้น ๆ
