ผู้ใดก่อให้ผู้อื่นกระทำความผิดไม่ว่าด้วยการใช้ บังคับ ขู่เข็ญจ้าง วาน หรือยุยงส่งเสริม หรือด้วยวิธีอื่นใด ผู้นั้นเป็นผู้ใช้ให้กระทำความผิด ถ้าผู้ถูกใช้ได้กระทำความผิดนั้น ผู้ใช้ต้องรับโทษเสมือนเป็นตัวการ ถ้าความผิดมิได้ กระทำลง ไม่ว่าจะเป็นเพราะผู้ถูกใช้ไม่ยอมกระทำ ยังไม่ได้กระทำหรือเหตุอื่นใด ผู้ใช้ต้องระวางโทษ เพียงหนึ่งในสามของโทษที่กำหนดไว้สำหรับความผิดนั้น
