ผู้ใดโฆษณาหรือประกาศแก่บุคคลทั่วไปให้กระทำความผิด และ ความผิดนั้นมีกำหนดโทษไม่ต่ำกว่าหกเดือ ผู้นั้นต้องระวางโทษกึ่งหนึ่งของโทษที่ก หนดไว้สำหรับ ความผิดนั้น ถ้ ได้มีการกระทำความผิดเพราะเหตุที่ได้ารโฆษณาหรือประกาศตามความใน วรรคแรกผู้โฆษณาหรือประกาศต้องรับโทษเสมือนเป็นตัวการ
