ถ้าโฉนดที่ดินใบไต่ส่วนหนังสือ สร้างใหม่ รับรองการทำประโยชน์หรือใบจองฉบับสำนักงาน ทั้งคู่ฉบับ ที่ดินเป็นอันตรายชำรุด สูญหายให้พนักงานเจ้าหน้าที่ ตามมาตรา ๗๑ มีอำนาจเรียกหนังสือแสดงสิทธิใน ที่ดินดังกล่าวจากผู้มีสิทธิในที่ดินมาพิจารณาแล้วจัดทำ * กฎกระทรวงฉบับที่๔๓(พ.ศ.๒๕๓๗)ออกตามความในพระราชบัญญัติ ให้ใช้ประมวลกฎหมายที่ดินพ.ศ.๒๔๙๗ ๕๑ ขึ้นใหม่โดยอาศัยหลักฐานเดิมได้*
