ความผิดร้ายแรงเกี่ยวกับยาเสพติดตามประมวลกฎหมายนี้ที่มีโทษจำคุกและปรับ ให้ศาลลงโทษจำคุกและปรับด้วยเสมอ โดยคำนึงถึงการลงโทษในทางทรัพย์สินเพื่อป้องกันและ ปราบปรามการกระทำความผิดร้ายแรงเกี่ยวกับยาเสพติด ถ้าศาลเห็นว่าการกระทำความผิดตามวรรคหนึ่งของผู้ใดเมื่อได้พิเคราะห์ถึงความร้ายแรงของ การกระทำความผิด ฐานะทางเศรษฐกิจของผู้กระทำความผิดและพฤติการณ์ที่เกี่ยวข้องประกอบแล้ว กรณีมีเหตุอันสมควรเป็นการเฉพาะราย ศาลจะลงโทษจำคุกหรือปรับน้อยกว่าอัตราโทษที่กฎหมาย กำหนดไว้สำหรับความผิดนั้นก็ได้ เลม่ ๑๓๘ ตอนที่ ๗๓ ก หนา้ ๗๐
