กรรมการผู้ทรงคุณวุฒิมีวาระการดำรงตำแหน่งคราวละสามปี เมื่อครบกำหนดตามวาระในวรรคหนึ่ง หากยังมิได้แต่งตั้งกรรมการผู้ทรงคุณวุฒิขึ้นใหม่ ให้กรรมการผู้ทรงคุณวุฒิซึ่งพ้นจากตำแหน่งตามวาระนั้นอยู่ในตำแหน่งเพื่อปฏิบัติหน้าที่ต่อไปจนกว่า กรรมการผู้ทรงคุณวุฒิซึ่งได้รับแต่งตั้งใหม่เข้ารับหน้าที่ กรรมการผู้ทรงคุณวุฒิซึ่งพ้นจากตำแหน่งตามวาระอาจได้รับแต่งตั้งอีกได้ แต่จะดำรงตำแหน่ง ติดต่อกันเกินสองวาระไม่ได้
