ในกรณีที่กรรมการผู้ทรงคุณวุฒิพ้นจากตำแหน่งก่อนวาระ ให้แต่งตั้งผู้อื่น ดำรงตำแหน่งแทน เว้นแต่วาระของกรรมการผู้ทรงคุณวุฒิจะเหลือไม่ถึงเก้าสิบวัน จะไม่แต่งตั้งกรรมการ ผู้ทรงคุณวุฒิแทนก็ได้ และให้ผู้ได้รับแต่งตั้งแทนตำแหน่งที่ว่างนั้นอยู่ในตำแหน่งเท่ากับวาระที่เหลืออยู่ ของกรรมการผู้ทรงคุณวุฒิซึ่งได้แต่งตั้งไว้แล้ว ในระหว่างที่ยังไม่ได้แต่งตั้งกรรมการผู้ทรงคุณวุฒิแทนตำแหน่งที่ว่าง ให้คณะกรรมการ ป.ป.ส. ประกอบด้วยกรรมการเท่าที่เหลืออยู่
