กฎกระทรวง กำหนดอัตราและวิธีการรับบำเหน็จดำรงชีพ พ.ศ. ๒๕๔๘ อาศัยอำนาจตามความในมาตรา ๕ แห่งพระราชบัญญัติบำเหน็จบำนาญข้าราชการส่วน ท้องถิ่นพ.ศ. ๒๕๐๐ และมาตรา ๔๖/๑ วรรคสอง แห่งพระราชบัญญัติบำเหน็จบำนาญข้าราชการ ส่วนท้องถิ่น พ.ศ. ๒๕๐๐ ซึ่งแก้ไขเพิ่มเติมโดยพระราชบัญญัติบำเหน็จบำนาญข้าราชการส่วน ท้องถิ่น (ฉบับที่ ๗) พ.ศ. ๒๕๔๘ รัฐมนตรีว่าการกระทรวงมหาดไทยออกกฎกระทรวงไว้ ดังต่อไปนี้
