เลม่ ๑๓๖ ตอนที่ ๑๔๑ ก หนา้ ๕ กฎกระทรวง กำหนดค่ำใช้จ่ำยในกำรจัดเก็บภำษีแทนองค์กรปกครองส่วนท้องถิ่น พ.ศ. 2562 อำศัยอำนำจตำมควำมในมาตรา ๖ วรรคหนึ่ง และมาตรา ๑๒ แห่งพระรำชบัญญัติ ภำษีที่ดินและสิ่งปลูกสร้ำง พ.ศ. ๒๕๖๒ รัฐมนตรีว่ำกำรกระทรวงมหาดไทยออกกฎกระทรวงไว้ ดังต่อไปนี้

ให้ส่วนรำชกำรที่รับชำระภำษีแทนองค์กรปกครองส่วนท้องถิ่นหักค่ำใช้จ่ำย ในกำรจัดเก็บภำษีในอัตรำร้อยละสำมของภำษีที่รับชำระไว้แทนนั้น

ให้ส่วนรำชกำรนำส่งภำษีหลังหักค่ำใช้จ่ำยตำมข้อ ๑ แล้ว ให้แก่องค์กรปกครอง ส่วนท้องถิ่นภำยในวันที่สิบของเดือนถัดไป ให้ไว้ ณ วันที่ 20 ธันวาคม พ.ศ. ๒๕๖2 พลเอกอนุพงษ์ เผ่ำจินดำ รัฐมนตรีว่ำกำรกระทรวงมหาดไทย เลม่ ๑๓๖ ตอนที่ ๑๔๑ ก หนา้ ๖ หมำยเหตุ :- เหตุผลในกำรประกาศใช้กฎกระทรวงฉบับนี้ คือ โดยที่มาตรา ๑๒ แห่งพระรำชบัญญัติ ภำษีที่ดินและสิ่งปลูกสร้ำง พ.ศ. ๒๕๖๒ บัญญัติให้ในกรณีที่องค์กรปกครองส่วนท้องถิ่นมอบหมำย ให้ส่วนรำชกำรหรือหน่วยงำนของรัฐรับชำระภำษีแทน ส่วนรำชกำรหรือหน่วยงำนของรัฐนั้นอำจได้รับส่วนลด หรือค่ำใช้จ่ำยในกำรจัดเก็บภำษีตำมอัตรำที่กำหนดในกฎกระทรวง จึงจำเป็นต้องออกกฎกระทรวงนี้
