ฉบับพิเศษ เล่ม ๑๐๒ หน้า ตอนที่ ๑๕๓ ๑๘ ธันวาคม ๒๕๒๘ กฎกระทรวง ฉบับที่ ๒ (พ.ศ. ๒๕๒๘) ออกตามความในพระราชบัญญัติทนายความ พ.ศ. ๒๕๒๘ อาศัยอำนาจตามความในมาตรา 4 บัญญัติทนายความ พ.ศ. ๒๕๒๘ ออกกฎกระทรวงไว้ ดังต่อไปนี้

และมาตรา ๒๔ แห่งพระราช รัฐมนตรีว่าการกระทรวงยุติธรรม ในกฎกระทรวง เลขาธิการ หมายความว่า นายทะเบียน หมายความว่า เลขาธิการสภาทนายความ นายทะเบียนสภาทนายความ กรรมการสภาทนายความประจำภาค หมายความว่า กรรมการ สภาทนายความซึ่งมีสำนักงานประจำอยู่ตามภาคต่างๆ ตามพระราช กฤษฎีกาตั้งอธิบดีผู้พิพากษาภาค ผู้ใดประสงค์จะขอจดทะเบียนและรับใบอนุญาต ให้ยืน คำขอพร้อมด้วยหลักฐานตามที่ระบุไว้ในแบบ ท้ายกฎกระทรวงนี้

ท. ๑ ฉบับพิเศษ เล่ม ๑๐๒ ตอนที่ ๑๕๓ ราชกิจจานุเบกษา ๑๘ ธันวาคม ๒๕๒๘ คำขอตามวรรคหนึ่งต้องมีหนายความอย่างน้อยหนึ่งคนซึ่งได้จด ทะเบียนและรับใบอนุญาตมาแล้วเป็นเวลารวมกันไม่น้อยกว่าสิบปี ลง ผู้ยื่นคำขอไม่เป็นผู้มีความประพฤติเสื่อมเสียหรื ลายมือชื่อรับรองว่า บกพร่องในศีลธรรมอันดี และไม่เป็นผู้กระทำการใดซึ่งแสดงให้เห็นว่า ไม่น่าไว้วางใจในความซื่อสัตย์สุจริต
