ในกรณีที่ไม่อาจดำเนินการให้แล้วเสร็จภายในระยะเวลาตามข้อ ๓ หรือข้อ ๔ ให้กระทรวงคมนาคมรายงานผลการดำเนินการ รวมทั้งสาเหตุของการดำเนินการไม่แล้วเสร็จ ไปยังนายกรัฐมนตรี โดยนายกรัฐมนตรีอาจพิจารณาขยายระยะเวลาออกไปได้อีกตามที่เห็นสมควรก็ได้
