ในกรณีที่คณะกรรมการคัดเลือกและคณะกรรมการกำกับดูแลไม่อาจดำเนินการ ให้แล้วเสร็จภายในระยะเวลาตามข้อ ๔ และนายกรัฐมนตรีไม่อนุมัติให้มีการขยายระยะเวลาออกไป ตามข้อ ๕ หรือในกรณีที่คณะกรรมการคัดเลือกและคณะกรรมการกำกับดูแลไม่สามารถหาข้อยุติได้ตามข้อ ๔ ให้ยุติการดำเนินการดังกล่าวและให้กระทรวงคมนาคมรายงานผลการดำเนินการไปยังคณะรัฐมนตรี เพื่อพิจารณา
