ภายใต้บังคับมาตรา ๕ ข้าราชการซึ่งมีสิทธิเข้าร่วมโครงการต้องเป็นข้าราชการ ในสังกัดส่วนราชการ ดังต่อไปนี้
(๑) ส่วนราชการที่คณะรัฐมนตรีมีมติให้ออกจากระบบราชการ
(๒) ส่วนราชการที่ประสงค์จะยุบเลิกบางภารกิจ
(๓) ส่วนราชการที่มีอัตรากำลังเกินความจำเป็น หรือ
(๔) ส่วนราชการที่มีจำนวนข้าราชการอายุตั้งแต่ห้าสิบปีบริบูรณ์ขึ้นไปมากกว่าร้อยละยี่สิบ ของจำนวนข้าราชการทั้งหมดของส่วนราชการนั้น
