เมื่อ ก.พ.ค.ตร. พิจารณาวินิจฉัยอุทธรณ์แล้ว ให้ผู้บังคับบัญชาซึ่งสั่งลงโทษ ดำเนินการให้เป็นไปตามคำวินิจฉัยนั้นภายในสามสิบวันนับแต่วันที่ ก.พ.ค.ตร. มีคำวินิจฉัย ในกรณีที่ผู้อุทธรณ์ไม่เห็นด้วยกับคำวินิจฉัยอุทธรณ์ของ ก.พ.ค.ตร. ให้ฟ้องคดีต่อศาลปกครองสูงสุด ภายในเก้าสิบวันนับแต่วันที่ทราบหรือถือว่าทราบคำวินิจฉัยของ ก.พ.ค.ตร. ผู้บังคับบัญชาผู้ใดไม่ปฏิบัติตามวรรคหนึ่ง ให้ถือว่าเป็นการจงใจละเว้นการปฏิบัติหน้าที่โดยมิชอบ เพื่อให้เกิดความเสียหายแก่บุคคลอื่น
