ข้าราชการตำรวจผู้ใดเห็นว่าผู้บังคับบัญชาใช้อำนาจหน้าที่ปฏิบัติต่อตน โดยไม่ถูกต้องหรือไม่ปฏิบัติต่อตนให้ถูกต้องตามระเบียบ กฎหมาย หรือเกิดจากการปฏิบัติโดยมิชอบ ของผู้บังคับบัญชาต่อตน หรือกฎ ก.ตร. ที่ออกมาใช้บังคับขัดหรือแย้งต่อพระราชบัญญัตินี้ หรือ ก่อให้เกิดความไม่เป็นธรรม ผู้นั้นอาจร้องทุกข์ต่อผู้บังคับบัญชาหรือ ก.พ.ค.ตร. แล้วแต่กรณี เพื่อขอให้ แก้ไขได้ เว้นแต่เป็นกรณีที่มีสิทธิอุทธรณ์ตามหมวด ๙ การอุทธรณ์ ให้ใช้สิทธิอุทธรณ์ตามที่กำหนดไว้ ในหมวดนั้น
