การดำเนินการให้มีการตั้งครรภ์แทนตามพระราชบัญญัตินี้ให้กระทำได้สองวิธี ดังต่อไปนี้ เล่ม ๑๓๒ ตอนที่ ๓๘ ก
(๑) ใช้ตัวอ่อนที่เกิดจากอสุจิของสามีและไข่ของภริยาที่ชอบด้วยกฎหมายที่ประสงค์จะให้มี การตั้งครรภ์แทน
(๒) ใช้ตัวอ่อนที่เกิดจากอสุจิของสามีหรือไข่ของภริยาที่ชอบด้วยกฎหมายที่ประสงค์จะให้มี การตั้งครรภ์แทนกับไข่หรืออสุจิของผู้อื่น ทั้งนี้ ห้ามใช้ไข่ของหญิงที่รับตั้งครรภ์แทน
