ในกรณีที่สามีและภริยาที่ชอบด้วยกฎหมายซึ่งประสงค์ให้มีการตั้งครรภ์แทน ถึงแก่ความตายก่อนเด็กเกิด ให้หญิงที่รับตั้งครรภ์แทนเป็นผู้ปกครองเด็กนั้นจนกว่าจะมีการตั้งผู้ปกครองขึ้นใหม่ ทั้งนี้ ให้หญิงที่รับตั้งครรภ์แทน พนักงานเจ้าหน้าที่ตามกฎหมายว่าด้วยการคุ้มครองเด็ก ผู้มีส่วนได้เสีย หรือพนักงานอัยการมีอำนาจร้องขอต่อศาลให้ตั้งผู้ปกครองได้ และในการตั้งผู้ปกครองดังกล่าวให้ศาล คำนึงถึงความผาสุกและประโยชน์ของเด็กนั้นเป็นสำคัญ
