ในกรณีที่ปรากฏว่าผู้ปฏิบัติการ หน่วยปฏิบัติการ หรือสถานพยาบาลใด ไม่ปฏิบัติตามหลักเกณฑ์ เงื่อนไข และมาตรฐานการปฏิบัติการฉุกเฉิน ให้ กพฉ. ดำเนินการสอบสวน เพื่อพิจารณากำหนดมาตรการตามมาตรา ๓๒ เล่ม ๑๒๕ ตอนที่ ๔๔ ก ในการสอบสวนตามวรรคหนึ่ง ให้ กพฉ. มีอำนาจเรียกบุคคลใด ๆ มาให้ถ้อยคำหรือแจ้งให้ บุคคลใด ๆ ส่งเอกสารหรือวัตถุที่จำเป็นแก่การดำเนินการตามอำนาจและหน้าที่
