ข้อกำหนดใดในสัญญา ซึ่งมีวัตถุประสงค์หรือมีผลไม่ว่าโดยตรงหรือโดยปริยาย เป็นการปลดเปลื้องหน้าที่หรือความรับผิดของผู้ขนส่ง ทำให้เสื่อมสิทธิแก่ผู้ส่งหรือผู้รับตราส่งตามที่บัญญัติไว้ ในพระราชบัญญัตินี้ หรือกำหนดให้มีการทำการประกันภัยเพื่อประโยชน์ของผู้ขนส่ง ข้อกำหนดนั้นเป็นโมฆะ ความในมาตรานี้ไม่ตัดสิทธิคู่สัญญาที่จะกำหนดหน้าที่และความรับผิดของผู้ขนส่งไว้ไม่ต่ำกว่าที่ กำหนดไว้ในพระราชบัญญัตินี้
