ผู้ใดล่วงรู้หรือได้มาซึ่งความลับของผู้ประกอบธุรกิจโดยเหตุที่เป็นกรรมการ ผู้ซึ่งมีอำนาจจัดการ พนักงาน หรือลูกจ้าง ของผู้ประกอบธุรกิจ และเปิดเผยความลับนั้นในประการ ที่น่าจะก่อให้เกิดความเสียหายแก่บุคคลอื่นหรือประชาชน ต้องระวางโทษจำคุกไม่เกินหนึ่งปี หรือปรับ ไม่เกินหนึ่งแสนบาท หรือทั้งจำทั้งปรับ ความในวรรคหนึ่งมิให้ใช้บังคับกับการเปิดเผยตามกรณีในมาตรา ๕๔ วรรคสอง
