ผู้ใดประสงค์จะจัดตั้งเขตปลอดอากรเพื่อประโยชน์ทางอากรศุลกากรใน การประกอบอุตสาหกรรม พาณิชยกรรม หรือกิจการอื่นที่เป็นประโยชน์แก่การเศรษฐกิจของประเทศ ต้องได้รับใบอนุญาตจากอธิบดี การขออนุญาตและการอนุญาตตามวรรคหนึ่ง ให้เป็นไปตามหลักเกณฑ์ วิธีการ และเงื่อนไข ที่กำหนดในกฎกระทรวง และเมื่อได้รับอนุญาตแล้วจึงจะดำเนินการจัดตั้งเขตปลอดอากรนั้นได้
