ในกรณีที่ความผิดตามพระราชบัญญัตินี้เกิดขึ้นในทะเลอาณาเขต เมื่อพนักงาน ศุลกากรจับผู้กระทำความผิดและส่งให้พนักงานสอบสวนแห่งท้องที่ใด ให้พนักงานสอบสวนแห่งท้องที่นั้น เป็นพนักงานสอบสวนผู้รับผิดชอบ และมิให้นับระยะเวลาเดินทางตามปกติที่นำตัวผู้กระทำความผิดส่งให้ พนักงานสอบสวนเป็นเวลาควบคุมผู้ต้องหาของพนักงานสอบสวนตามประมวลกฎหมายวิธีพิจารณา ความอาญา
