ในกรณีที่เจ้าหน้าที่ฝ่ายทหารนำอากาศยานขึ้นสกัดกั้นแล้ว แต่ไม่อาจสกัดกั้น อากาศยานนั้นได้ หรือไม่อาจนำอากาศยานขึ้นสกัดกั้นได้ทัน หากอากาศยานนั้นมีการกระทำอันอาจ เป็นภัยต่อความมั่นคงแห่งราชอาณาจักรหรืออาจเป็นภัยต่อสาธารณะ ให้เจ้าหน้าที่ฝ่ายทหารมีอำนาจ ใช้อาวุธจากภาคพื้นสู่อากาศเพื่อทำลายอากาศยานนั้นได้ โดยให้นำความในมาตรา ๑๒(๒) มาใช้บังคับ
