ในกรณีที่เจ้าหน้าที่ฝ่ายทหารนำอากาศยานขึ้นสกัดกั้นหรือมีการปฏิบัติการ เพื่อทำลายอากาศยานจากภาคพื้นตามพระราชบัญญัตินี้ หากปรากฏว่าอากาศยานนั้นฝ่าฝืนบทบัญญัติ แห่งกฎหมาย หรืออนุสัญญาหรือความตกลงระหว่างประเทศ หรือมีการกระทำอันอาจเป็นภัยต่อความ มั่นคงแห่งราชอาณาจักรหรืออาจเป็นภัยต่อสาธารณะ ให้เจ้าของอากาศยานหรือผู้ควบคุมอากาศยาน รับผิดชดใช้ค่าใช้จ่ายตามหมวดนี้
